Thank you for choosing GOŠEK, organizacija doživetij, Luka Gošek s.p. (hereinafter referred to as the travel agency) to curate your travel experiences. Our Terms and Conditions outline the guidelines governing the use of our services, ensuring a seamless and enjoyable journey for every adventurer. By booking an experience with us, you agree to comply with these terms.
1. Booking and Confirmation: To secure your booking, please follow the provided payment instructions. Once your payment is received, you will receive a confirmation email detailing essential information about your selected experience.
2. Cancellation Policy: We understand that plans may change. However, please note the following cancellation fees:A cancellation fee of 100% will be charged if the booking is canceled 1 day and 12 hours or less before the scheduled event.A cancellation fee of 50% will be charged if the booking is canceled 7 days or less before the scheduled event.A cancellation fee of 10% will be charged if the booking is canceled 365 days or less before the scheduled event.In case that subcontractor’s or third-party supplier’s cancellation terms are stricter, their cancellation terms will be followed.
3. Changes to Bookings: We recognize that adjustments may be necessary. Changes to bookings, including modifications to dates or participant details, may be considered based on availability and at the discretion of the travel agency. Any associated costs arising from these changes are the responsibility of the traveler.
4. Refunds: Refunds will be processed in accordance with the provided cancellation policy. The timeframe for refund processing may vary, and the method of refund will be determined by the original payment method.
5. Responsibilities of Travelers: Travelers are responsible for ensuring they meet specific requirements related to health, visas, and documentation for their chosen destination. The client is fully responsible for all the costs and consequences, which may occur due to incorrect information they had provided to the agency. Failure to comply with these requirements may result in disruptions or issues during the travel experience, for which the travel agency cannot be held responsible. The client is personally liable for any misbehavior or damage caused by misbehavior, particularly for damage resulting from not respecting these General Terms and Conditions. The client is responsible for covering any damage immediately at the designated location specified by the natural or legal person that has suffered from damage.
6. Travel Insurance: We strongly recommend that all travelers obtain comprehensive travel insurance covering medical emergencies, trip cancellations, and other unforeseen events. The travel agency is not responsible for any expenses incurred due to the lack of travel insurance.
7. Force Majeure: The travel agency shall not be liable for any failure or delay in performance arising out of circumstances beyond our reasonable control, including but not limited to acts of God, governmental actions, pandemics, and other unforeseen events.
8. Weather Disclaimer: At GOŠEK, we strive to provide you with unforgettable experiences. However, if there is a forecast of inclement weather that, in the opinion of our tour agency, may significantly impact the safety and enjoyment of the tour, we reserve the right to cancel or modify the experience. Your safety and satisfaction are our top priorities, and we appreciate your understanding in unpredictable weather situations. In such cases, we will make every effort to offer an alternative or reschedule the tour when feasible.
9. Limitation of Liability: The travel agency is committed to your safety and satisfaction. However, we cannot be held liable for any loss, damage, injury, or additional expenses incurred during the travel experience, unless such incidents result from our negligence.
10. Primary language: The primary language of our services is english.
11. Image and Digital Content Usage: By participating in our experiences, you grant the travel agency the right to use any images or digital content captured during the event for promotional purposes. This material may include images or videos of clients. We assure you that we will not sell or distribute the media with third parties. If you have concerns about the use of specific content, please notify us in advance.
12. Complaints: Every traveler, holding a travel agreement with the travel agency, has the right to submit complaints related to unsatisfactory services provided by the company. In accordance with the applicable laws, the traveler must outline the reasons for filing a complaint and provide relevant evidence of unsatisfactory service, including irregularities or deviations from the originally agreed and paid travel arrangement. The traveler is required to submit a written complaint within 15 (fifteen) days after the conclusion of the travel arrangement at the latest.Tour confirmation serves as the basis for further reimbursement claims, such as payment receipts or any other supporting documents. If the travel agency is responsible for the non-execution of the travel arrangement or specific services included in the travel plan, the traveler is entitled to a refund or partial refund based on the actual value of the unsatisfactory services.In cases where the company fails to provide agreed services, the traveler is entitled to a refund for the unused services, as per the regulations outlined in the Consumer Protection Act. The travel agency is exempt from any refund claim in situations explicitly stated in section 7, allowing it to cancel, change, or modify the agreed travel arrangement.
13. Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of Slovenia. During the tours, all participants are obliged to adhere to Slovenian laws.
14. Additional Terms: All prices for travel arrangements provided by the travel agency include any additional taxes. The travel agency does not take responsibility for mistakes that may occur in promotional material, including catalogues, leaflets, brochures, and websites.
15. Changes to Terms and Conditions: We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting on our website.
